Microsoft kan tvingas lämna ut e-post till USA, lagrad i Irland

I onsdags möttes den amerikanska polismyndigheten och Microsoft i rättssalen. Ärendet gäller om amerikanska teknikbolag ska tvingas lämna ut data från servrar placerade utomlands.

I detta specifika fall vill polisen att Microsoft ska lämna ut e-post tillhörande en person som är inblandad i en drogutredning. Microsoft säger nej till detta och hänvisar till att servrarna står på Irland där de enligt europeisk lagstiftning inte behöver lämna ut någon information.

“Får myndigheterna rätt kan detta leda till stora konsekvenser för hela molnbranschen”, säger Peter Nordbeck, jurist på advokatfirman Delphi till IDG.

”Det kan innebära att de som tecknat avtal med amerikanska molnföretag inte kan känna sig säkra på att deras information inte lämnas ut. Även om det står i avtalet att det är europeisk lagstiftning som gäller. Det är en osäkerhet man måste ta ställning till, en riskbedömning man måste göra, säger han.”

Idag använder sig många svenska myndigheter och kommuner av amerikanska molntjänster med uppfattningen att tjänsten är skyddad av EU:s lagstiftning men nu kan allt detta förändras.

“Det blir en besvärlig sits för företagen också. De måste följa EU:s lagstiftning i sina avtal samtidigt som de måste följa den amerikanska och lämna ut data om myndigheter kräver det. Lagarna ställs mot varandra,” säger Peter Nordbeck.

Ärendet har varit på kartan tidigare i amerikansk rättssal och två gånger tidigare har Microsoft förlorat. Blir det ett negativt besked även i detta fall kan det innebära slutet för amerikanska molntjänster i Europa.

Det kan inte uteslutas, men man får hoppas att det inte går så långt. Det i sin tur skulle innebära en konkurrensfördel för svenska och europeiska företag. Men det återstår att se, säger Peter Nordbeck.
